Federal Disability Retirement (FERS and CSRS)

Andalman & Flynn: successfully piecing together the puzzle of the Federal Disability Retirement Application to obtain approval for disability benefits.

At Andalman & Flynn, we fight for and we defend the rights of federal workers across the United States to protect and secure their financial future.

Imagine this: You are a federal employee in a secure and high-ranking position within a federal government agency. You have 22 years of federal service, you rarely ever miss a day of work and have had nothing but outstanding performance reviews throughout your federal service. All of a sudden, the secure life that you have been enjoying is brought to a screeching halt because you suffer a severe head injury. You try to work but when you go to work you are unable to concentrate and have great difficulty with comprehension and memory to the point that you cannot satisfactorily perform your job duties anymore, and the agency has to have a co-worker pick up the slack. You also suffer fatigue and headaches that cause you to miss work and your attendance becomes unacceptable. You are devastated by this, but feel that financially you cannot stop working.

All you can think is “What am I going to do and how am I going to financially survive?”

There is help for you, and it is help to which you are entitled. Federal Disability Retirement (known in our office as “FDR”) is a right of all employees covered under either the Civil Service Retirement System (CSRS) or the Federal Employees Retirement System (FERS). After meeting certain requirements, these covered federal workers can collect a portion of their salary if a medical condition prevents them from performing “useful and efficient” federal service in their position or a reasonably comparable position within the federal government. This benefit is not given to you as a favor or a handout. You have paid for these disability retirement benefits with contributions to your retirement fund through payroll deductions over your years of federal service.

If you are a federal worker covered under the FERS or CSRS retirement systems and have become unable to work due to a medical condition, you should contact Andalman & Flynn. We have experienced and knowledgeable attorneys who can represent you through all stages of the initial application process as well as any necessary appeals, including before the Merit Systems Protection Board (MSPB). Our attorneys can also represent you on other matters that may arise out of your inability to perform useful and efficient federal service, such as proposed removals and other disciplinary actions.

The application for FDR includes numerous forms that can be complex and difficult to piece together. The application is like a puzzle with each piece going through different channels before it is put together as a complete packet for submission to the Office of Personnel Management (OPM). Our staff will work with you on your application forms and statements and with the other necessary offices, which may include your supervisor, doctors, agency human resources, payroll and legal offices and OPM. We will put together the pieces of the puzzle to appropriately present your claim and maximize your chances of gaining approval of your application.

Here at Andalman & Flynn, we have an extremely high win rate on these claims. If you are, or know someone who is, a federal employee covered under FERS or CSRS and cannot continue working in a federal job because of a medical disability, please contact us for a free initial consultation.

  • Coordination of FERS Disability Benefits and Social Security Disability Benefits [PDF]
Description: The Office of Personnel Management (OPM) requires that Federal Employees Retirement System (FERS) disability retirement annuitants apply for Social Security Disability (SSD) benefits.
  • DISABILITY RETIREMENT BENEFITS FOR FEDERAL EMPLOYEES AND POSTAL WORKERS: AN OVERVIEW [PDF]
Description: Employees of the Federal Government and the United States Postal Service have an array of retirement benefits available to them. The Office of Personnel Management (OPM) manages these benefits. The two main programs for civilian federal workers who become disabled to perform federal service are the Federal Employees Retirement System (FERS) and the Civil Service Retirement System (CSRS). Under both programs the disabled federal employee must have a medical condition or medical conditions that prevents him or her from performing “useful and efficient” federal service at his or her current grade or pay. There is no requirement that the employee be totally disabled nor is it necessary that the disease or illness be caused by the employee’s job.
  • Federal Disability Retirement - Know Your Time Limit to Appeal! - Appealing an OPM Decision to the MSPB [PDF]
Description: This article sets forth the time limit for filing an MSPB appeal after receipt of a final written decision from OPM on claims for federal disability retirement benefits. It provides information on when, where and how to file an MSPB appeal as well as the computation of time for filing and good cause for filing untimely.
  • TURN A REMOVAL ACTION TO YOUR ADVANTAGE: HOW TO USE GETTING TERMINATED TO HELP WIN A DISABILITY RETIREMENT [PDF]
Description: Is your Agency threatening to terminate you from your job because of performance or attendance problems related to a medical condition? If so, your situation may not be as bad as you think it is. Removal from your job may actually be a good thing.

If your inability to perform your job is the result of a medical condition(s), and you want to receive a disability retirement under FERS or CSRS, being terminated may help you. If you are removed from federal service by your Agency due to your medical condition, such a removal increases your chances of getting an application for disability retirement approved by OPM.
